§ 4. Products and Product Information
-
Information displayed in connection with a Product specifies in particular its type, principal characteristics, price, available variants, quantity or weight and other information required by law.
-
In the case of Coffee, the Product description may include in particular:
-
country and region of origin;
-
producer, farm or processing station;
-
botanical variety;
-
processing method;
-
roast profile;
-
recommended brewing methods;
-
weight;
-
sensory notes;
-
roast date, batch number or best-before date, where applicable.
-
-
Food information required before purchase is made available on the Product page or elsewhere in the purchasing process. Information that may lawfully be provided upon delivery is stated on the packaging, label or material supplied with the Product.
-
Flavour and aroma notes describe the sensory character of the Coffee. Unless expressly stated otherwise, they do not indicate that flavourings or ingredients corresponding to those notes have been added.
-
Perception of flavour and aroma may vary depending on the water, grinder, brewing equipment, grind settings, recipe, temperature and preparation method used.
-
Coffee is an agricultural product. Reasonable differences may occur between harvests, green-coffee lots and roasting batches in colour, bean appearance, aroma or sensory profile. Such differences do not constitute non-conformity where the Product retains the characteristics resulting from its description and the Sales Contract.
-
Product photographs are for presentation purposes. Colour may differ slightly due to the Customer’s screen, lighting or photographic conditions. This does not limit the Seller’s obligation to deliver a Product conforming to the Sales Contract.
-
Accessories must be used in accordance with their intended purpose, instructions, warnings and safety information provided by the manufacturer, importer, responsible person or Seller.
-
Information identifying the Product, manufacturer, importer or responsible person and legally required safety warnings is made available to the extent required by applicable law.
-
Product availability may change. Displaying a Product in the Store does not guarantee its continuous availability.
§ 5. Placing Orders and Conclusion of the Sales Contract
-
Orders may be submitted through the Store at any time, subject to technical interruptions.
-
Product information presented in the Store constitutes an invitation to submit offers and is not itself an offer by the Seller within the meaning of the Polish Civil Code.
-
To place an Order, the Customer must:
-
select the Product and an available variant;
-
add the Product to the shopping cart;
-
provide the required contact, billing and delivery or collection information;
-
select an available delivery method or local pickup location;
-
select an available payment method;
-
review the Order summary, total price and delivery costs;
-
read these Terms and Conditions and the other required information;
-
accept these Terms and Conditions in the manner provided during checkout;
-
submit the Order using a button clearly indicating the obligation to pay.
-
-
Before submitting the Order, the Customer may review and correct the information entered and change the contents of the shopping cart.
-
Submission of an Order constitutes an offer to conclude a Sales Contract for the Products included in the Order.
-
After receiving the Order, the Seller sends an electronic acknowledgement of receipt.
-
The Sales Contract is concluded when the Customer receives a message confirming that the Order has been accepted for fulfilment. The acknowledgement of receipt and confirmation of acceptance may be contained in the same message where that message clearly states that the Order has been accepted.
-
The Order Confirmation and information required by law are provided to the Customer on a durable medium, normally by email.
-
The Seller may refuse an Order before conclusion of the Sales Contract for objective reasons, including where:
-
the Product is unavailable;
-
payment has not been successfully completed or verified;
-
the Customer’s information is incomplete or clearly incorrect;
-
there is a manifest error in the price or description;
-
there is a reasonable suspicion of fraud, abuse or unlawful activity;
-
delivery to the selected destination is impossible or unlawful.
-
-
If payment has already been collected and the Order is not accepted, the Seller will refund the amount received without undue delay using the original payment method, unless the Customer expressly agrees to another method that does not result in additional costs.
-
If only part of an Order is available, the Seller will contact the Customer. Partial fulfilment requires the Customer’s agreement. Any amount paid for unavailable Products will be refunded.
-
The Customer is responsible for providing complete and correct information required to fulfil the Order.
-
Wholesale Orders or individually negotiated B2B Orders may be governed by a separate offer, commercial terms or individual agreement. Individually agreed terms prevail to the extent that they govern the same matter.
§ 6. Prices, Promotions and Sales Documents
-
Product prices are stated in the currency displayed in the Store and include applicable value-added tax unless expressly stated otherwise.
-
Delivery costs and other unavoidable charges are displayed separately before the Order is submitted.
-
The total price displayed in the final summary includes the price of the Products, applicable taxes and the cost of the selected delivery method.
-
Where the Seller communicates a price reduction, the Seller also states the lowest price applied to the Product during the legally required reference period before the reduction, where that requirement applies.
-
Promotions and discount codes may be subject to separate conditions displayed in the Store. Unless otherwise stated, promotions and discount codes cannot be combined.
-
A change in the price of a Product does not affect Orders accepted before the change takes effect.
-
If a manifest pricing or technical error is discovered before an Order is accepted, the Seller will inform the Customer. The Customer may place or confirm the Order at the correct price but is not required to do so.
-
The Seller issues receipts, invoices and other sales documents in accordance with applicable law.
-
A Customer purchasing in connection with a business activity should provide correct business details and a tax identification number before submitting the Order.
§ 7. Payments
-
Available payment methods are displayed during checkout and may differ depending on the Customer’s location, currency, Order value or current Store configuration.
-
Electronic payments may be processed by external payment service providers. Where a provider supplies a separate service directly to the Customer, the provider’s own terms may also apply.
-
Unless the Store states otherwise, payment is due immediately after the Order is submitted.
-
Authorisation or collection of payment before the Order is accepted does not in itself constitute confirmation that the Sales Contract has been concluded.
-
If payment is not successfully completed, the Seller may request that the Customer make payment within a specified period. The Seller is not required to begin fulfilling the Order before payment has been confirmed unless otherwise agreed.
-
The Seller does not ask Customers to send full payment card numbers, security codes or online banking credentials by email.
§ 8. Delivery and Local Pickup
-
Delivery is available within Poland and to selected European Union countries.
-
Currently available destinations are those for which at least one delivery method is displayed after a complete address has been entered during checkout.
-
Availability of delivery to a particular country or location may change due to carrier coverage, legal or trade restrictions, Product type or operational circumstances.
-
Within Poland, available delivery methods may include in particular:
-
delivery to a parcel locker or collection point;
-
courier delivery.
-
-
Orders to other supported European Union countries are delivered using courier or other parcel delivery services available for the relevant destination.
-
Available delivery methods, their cost and available pickup locations are displayed before the Order is submitted. The Seller may change the carriers it works with without amending these Terms and Conditions.
-
Orders are normally prepared for dispatch or collection within 1–3 Business Days after the Order and, where applicable, payment have been confirmed.
-
In exceptional cases, including where a Product requires additional preparation, roasting or restocking, or where there is an unusually high volume of Orders, processing may take up to 7 Business Days.
-
A different period may apply to pre-orders or Products where that period was clearly stated before the Order was submitted or individually agreed with the Customer.
-
Carrier transit time begins when the parcel is dispatched and is not part of the Order processing time.
-
Delivery times displayed during checkout, in the Order Confirmation or in a carrier’s tracking system are estimates unless a particular date has expressly been agreed as guaranteed.
-
Unless another period has been agreed, the Product will be delivered without undue delay and no later than 30 days after conclusion of the Sales Contract.
-
In a contract with a Consumer or an Entrepreneur with consumer rights, the risk of accidental loss of or damage to a Product passes to the Customer when the Customer or a third party designated by the Customer other than the carrier takes physical possession of the Product, subject to exceptions provided by law.
-
The Customer must provide a complete and correct address, telephone number, email address and collection-point details where required for the selected delivery method.
-
If a parcel is returned because of:
-
an incorrect or incomplete address supplied by the Customer;
-
failure to collect it within the period specified by the carrier;
-
unsuccessful delivery due to circumstances attributable to the Customer,
the Seller may, to the extent permitted by law, require payment of reasonable and documented return or re-dispatch costs.
-
Failure to collect a parcel does not itself constitute a statement of withdrawal from the Sales Contract.
-
The Customer should inspect the parcel after delivery and report any damage, missing Product or incorrect Product as soon as reasonably possible. Photographs of the packaging, shipping label and Product may facilitate investigation of the matter.
-
Failure to inspect the parcel in the carrier’s presence or to obtain a damage report does not deprive a Consumer or an Entrepreneur with consumer rights of statutory complaint rights.
-
The Seller may deliver an Order in several parcels where reasonably necessary, provided that this does not impose additional costs on a Consumer without the Consumer’s express agreement.
-
Where this option is available during checkout, the Customer may select local pickup from one of the following locations:
Whisper Coffee
ul. Targowa 67, unit LU1
03-729 Warsaw
Po Drodze
ul. Bagatela 11
00-585 Warsaw
-
The Customer must select a pickup location during checkout and wait for a message confirming that the Order is ready for collection.
-
The Order may be collected during the current opening hours of the selected location or at another time agreed with the Seller.
-
The person collecting the Order may be asked to present the Order Confirmation or provide information allowing the relevant Order to be identified.
-
Po Drodze provides an additional pickup location only. Regardless of the selected location, TREJD sp. z o.o. remains the Seller, the party to the Sales Contract and the entity responsible for payments, Orders, complaints, returns and refunds.
§ 9. Right of Withdrawal from the Sales Contract
-
A Consumer or an Entrepreneur with consumer rights may withdraw from a distance Sales Contract without giving a reason within 14 days, subject to statutory exceptions.
-
The withdrawal period begins:
-
for a single Product – on the day on which the Customer or a third party designated by the Customer other than the carrier takes possession of the Product;
-
for several Products delivered separately, in batches or in parts – on the day on which the last Product, batch or part is received;
-
for regular delivery of Products over a defined period – on the day on which the first Product is received.
-
-
To exercise the right of withdrawal, the Customer must send the Seller an unequivocal statement before the period expires:
-
by email to kontakt@whispercoffee.pl; or
-
by post to the Seller’s address.
-
-
The Customer may use the model withdrawal form attached to these Terms and Conditions, but use of the form is not mandatory.
-
After submitting the statement, the Customer must return the Product without undue delay and no later than 14 days after informing the Seller of the withdrawal.
-
The Product should be returned to:
TREJD sp. z o.o. / Whisper Coffee
ul. Targowa 67, unit LU1
03-729 Warsaw
PolandIf the Seller provides a different current returns address after receiving the statement, the Product may be returned to that address.
-
The Seller’s prior consent is not required for the effective exercise of the statutory right of withdrawal.
-
The Customer bears the direct cost of returning a conforming Product following a change of mind, unless the Seller has agreed to bear that cost or failed to inform the Customer of this obligation.
-
The Seller will refund the payments due without undue delay and no later than 14 days after receiving the withdrawal statement.
-
The Seller may withhold the refund until the returned Product has been received or until the Customer provides evidence that it has been sent back, whichever occurs first.
-
The refund will be made using the original payment method unless the Customer expressly agrees to another method that does not involve additional costs.
-
Where the Customer withdraws from the entire Sales Contract, the refund includes the cost of the least expensive ordinary delivery method offered for that Order. Additional costs resulting from selection of a more expensive method are not refundable.
-
Where the withdrawal concerns only part of an Order, the original delivery costs are refunded to the extent required by law. If the delivery cost would have remained the same without the returned Products, it is not refunded.
-
The Customer is liable for any reduction in the value of the Product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.
-
Original transport packaging is not an absolute condition for return, but the Product must be adequately protected for return transport.
-
The right of withdrawal does not apply in cases specified by applicable law, including contracts concerning:
-
a non-prefabricated Product made to the Customer’s specifications or serving the Customer’s clearly individual needs;
-
a Product liable to deteriorate rapidly or having a short shelf life;
-
a Product supplied in sealed packaging that is not suitable for return for health-protection or hygiene reasons once opened, where the packaging was opened after delivery;
-
a Product that, due to its nature, becomes inseparably combined with another item after delivery;
-
other Products or contracts covered by a statutory exclusion from the right of withdrawal.
-
An unopened Coffee package with an intact heat seal, security seal or other first-opening protection may be returned in accordance with these Terms and Conditions.
-
In the case of Coffee supplied in sealed packaging, a statutory exclusion from the right of withdrawal may apply after a heat seal, security seal, protective film or other first-opening protection has been broken where the legal conditions relating to health protection, hygiene or food safety are met in the particular case.
-
Exclusion of the right of withdrawal due to opening the packaging does not limit the right to make a complaint concerning Coffee that is damaged, contaminated, unsafe, incorrect or otherwise not in conformity with the Sales Contract.
-
Further information about returns is provided in the Returns and Complaints Policy. In the event of a conflict, mandatory law and the provision more favourable to the Consumer prevail.
§ 10. Product Conformity and Complaints
-
The Seller is required to deliver to a Consumer or an Entrepreneur with consumer rights a Product that conforms to the Sales Contract.
-
A Product conforms to the contract where it corresponds in particular to the agreed description, type, quantity, quality, completeness, functionality, safety and other characteristics arising from the Sales Contract and applicable law.
-
Where a Product does not conform to the contract, the Customer may, in accordance with applicable law, request:
-
repair of the Product; or
-
replacement of the Product.
-
-
Where the statutory conditions are met, the Customer may also make a statement requesting:
-
a price reduction; or
-
withdrawal from the Sales Contract.
-
-
The Seller is responsible for a lack of conformity existing when the Product was delivered and disclosed, as a general rule, within 2 years after delivery, unless a longer period results from law, a warranty or the stated period during which the Product is fit for use.
-
A complaint may be submitted:
-
by email to kontakt@whispercoffee.pl; or
-
in writing to:
TREJD sp. z o.o. / Whisper Coffee
ul. Targowa 67, unit LU1
03-729 Warsaw
Poland
-
-
To facilitate efficient handling, the Customer is advised to provide:
-
the Customer’s name or details;
-
the Order number;
-
a description of the problem;
-
the date on which the problem was noticed;
-
the requested remedy;
-
photographs of the Product, label, batch number and packaging where they may assist in assessing the matter.
-
-
Failure to provide information or attachments that are not legally required and are not necessary to assess the particular complaint does not automatically result in rejection of the complaint.
-
A fiscal receipt is not the only acceptable proof of purchase. The purchase may also be established using an Order Confirmation, invoice, payment confirmation or other reliable evidence.
-
The Seller will respond to a complaint submitted by a Consumer or an Entrepreneur with consumer rights within 14 days of receiving it. Failure to respond within this period has the consequences specified by applicable law.
-
The Customer does not bear justified costs of a complaint based on lack of conformity. The Seller bears, in particular, the costs of collection, transport, repair or replacement to the extent required by law.
-
The method of making the Product available, collecting it or returning it will be agreed with the Customer. The Customer is advised to contact the Seller before independently returning a complained-about Product to avoid unagreed shipping costs.
-
In relation to Coffee, grounds for a complaint may include in particular:
-
receipt of an incorrect Product;
-
incorrect weight;
-
damaged or unsealed packaging;
-
contamination or the presence of a foreign object;
-
receipt of a Product after the applicable date;
-
material inconsistency with its description;
-
another lack of conformity with the Sales Contract.
-
Individual dissatisfaction with a correctly described Coffee sensory profile does not in itself constitute non-conformity.
-
If the Customer suspects contamination or another food-safety problem, the Customer should stop using the Product, retain the packaging and batch information where possible, and contact the Seller.
-
Opening a Coffee package does not deprive the Customer of the right to make a complaint where the problem could only be discovered after opening.
-
A manufacturer’s, importer’s or distributor’s warranty, where provided for an Accessory, is independent of and does not limit the Customer’s statutory rights against the Seller.
§ 11. Provisions Applicable to Entrepreneurs
-
This section applies only to Entrepreneurs who are neither Consumers nor Entrepreneurs with consumer rights.
-
The statutory right of withdrawal from a distance contract does not apply to such an Entrepreneur unless the Seller expressly agrees to accept the return or applicable law provides otherwise.
-
The Seller’s statutory warranty liability for defects toward such an Entrepreneur is excluded to the fullest extent permitted by Article 558 § 1 of the Polish Civil Code.
-
The exclusion does not apply where the Seller fraudulently concealed a defect or the parties expressly agreed otherwise.
-
To the fullest extent permitted by law, the Seller’s liability toward such an Entrepreneur:
-
covers only actual and direct loss;
-
does not cover lost profits, lost revenue or loss of business opportunities;
-
is limited in aggregate to the net value of the Order giving rise to the claim.
-
-
The limitations do not apply to damage caused intentionally or any other case in which liability cannot lawfully be excluded or limited.
-
A separate wholesale offer, B2B agreement or individually negotiated terms prevail over these Terms and Conditions to the extent that they govern the same matter.
§ 12. Personal Data and External Service Providers
-
The rules governing the processing of personal data, use of cookies and exercise of data-protection rights are set out in the Privacy Policy available in the Store.
-
The Seller processes personal data in particular for the purposes of:
-
operating the Store;
-
concluding and performing Sales Contracts;
-
accepting payments;
-
arranging delivery or local pickup;
-
maintaining Accounts;
-
handling complaints and returns;
-
complying with legal obligations;
-
conducting marketing where an appropriate legal basis exists.
-
-
The Seller may use external service providers, including an e-commerce platform provider, payment processors, hosting, email, analytics, customer-support and delivery providers.
-
An external provider’s terms may apply where that provider supplies a separate service directly to the Customer. Such terms do not replace the Sales Contract with the Seller or limit the Seller’s obligations.
-
Commercial communications are sent only in accordance with applicable law and the Customer’s choices. Marketing consent may be withdrawn at any time.
§ 13. Intellectual Property
-
The Store’s layout, photographs, graphics, texts, Product descriptions, logos, Whisper Coffee brand elements and other content may be protected by copyright, trademark rights or other intellectual property rights.
-
Those rights belong to the Seller or the relevant third parties.
-
The Customer may use Store content to the extent necessary to lawfully browse the Store and make purchases.
-
Without the authorisation of the relevant rights holder, the following are prohibited in particular:
-
commercial copying or distribution of content;
-
systematic extraction of Store data;
-
use of content to create competing materials, databases or products;
-
use of the Whisper Coffee brand in a manner suggesting a non-existent partnership, endorsement or sponsorship.
-
-
This section does not limit uses permitted by mandatory provisions of law.
§ 14. Liability and Circumstances Beyond Reasonable Control
-
Nothing in these Terms and Conditions limits the Seller’s liability toward a Consumer or an Entrepreneur with consumer rights where such limitation is prohibited.
-
The Seller is responsible for proper performance of the Sales Contract and conformity of the Product in accordance with applicable law.
-
The Seller is not responsible for deterioration or damage occurring after delivery solely as a result of:
-
storage contrary to the information on the packaging;
-
use of an Accessory contrary to its intended purpose or instructions;
-
unauthorised modification or improper maintenance;
-
incorrect delivery or contact information provided by the Customer,
unless mandatory law provides otherwise.
-
-
The Seller is not responsible for temporary Store unavailability caused by maintenance, telecommunications failure, a security incident or an external service provider where the circumstances were beyond the Seller’s reasonable control and the Seller took reasonable measures to mitigate their effects.
-
A party affected by an event beyond its reasonable control is not liable for delay to the extent and for the duration of that event.
-
Section 5 does not deprive the Customer of statutory rights relating to delayed delivery, withdrawal, refunds or non-conformity of the Product.
-
The Store may contain links to third-party websites. The Seller is not responsible for third-party content or services unless the Seller acts as their seller or provider or liability arises under applicable law.
§ 15. Governing Law, Courts and Alternative Dispute Resolution
-
These Terms and Conditions and Sales Contracts are governed by Polish law.
-
The choice of Polish law does not deprive a Consumer habitually resident in another country of protection granted by mandatory provisions of the law applicable in that country where private international law grants such protection.
-
Disputes involving a Consumer or an Entrepreneur with consumer rights are heard by the court having jurisdiction under applicable law.
-
Disputes involving an Entrepreneur who is neither a Consumer nor an Entrepreneur with consumer rights will be submitted to the court having territorial jurisdiction over the Seller’s registered office unless otherwise agreed or mandatory law provides otherwise.
-
A Consumer may use out-of-court complaint and redress procedures, including assistance from:
-
a municipal or district consumer ombudsman;
-
the competent Provincial Inspectorate of Trade Inspection;
-
a permanent consumer arbitration court;
-
another authorised consumer alternative dispute resolution entity.
-
-
After rejecting a Consumer’s complaint, the Seller will provide the information required by law concerning whether the Seller agrees or refuses to participate in an appropriate out-of-court procedure.
-
The Seller does not undertake to participate in proceedings before an alternative dispute resolution entity unless the Seller agrees to do so in the particular case or participation is required by law.
§ 16. Amendments and Final Provisions
-
The Seller may amend these Terms and Conditions for an important reason, including:
-
a change in applicable law or its binding interpretation;
-
a change in Store functionality;
-
a change in payment, delivery or pickup methods;
-
introduction, modification or withdrawal of services;
-
the need to improve security or prevent abuse;
-
a change in the Seller’s identification or contact information;
-
the need to correct errors or improve clarity.
-
-
Amended Terms and Conditions apply prospectively from the effective date stated in them.
-
Orders submitted before an amendment takes effect remain governed by the version accepted when the Order was placed unless mandatory law provides otherwise.
-
A Customer using an ongoing service such as an Account will be informed of a material amendment in an appropriate form. If the Customer does not accept an amendment affecting that service, the Customer may terminate the service before the amendment takes effect.
-
The Shipping Policy, Returns and Complaints Policy and Privacy Policy supplement these Terms and Conditions.
-
If any provision is found invalid or unenforceable, the remaining provisions continue in effect to the extent permitted by law.
-
The Polish and English versions are intended to have the same meaning. In the event of a discrepancy in interpretation, the Polish version prevails to the extent permitted by law.
-
These Terms and Conditions enter into force on 20 August 2026.
